By accessing and using VisaMate ("the Platform", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

VisaMate provides digital tools and resources to assist international students with their Australian student visa application process, including but not limited to:

  • University research database (43 universities and 7 TAFEs)
  • Statement of Purpose (SOP) builder and document generator
  • Form 157A pre-filling assistance
  • Document checklist and application tracker
  • Step-by-step guides and resources

3. Not a Migration Agent

IMPORTANT NOTICE:

VisaMate is NOT a registered migration agent. We do not provide migration advice, visa application services, or legal counsel. Our platform provides general information and tools to help you prepare your own application. You are solely responsible for the accuracy and completeness of your visa application.

For professional migration advice, please consult a registered migration agent (MARA) or the Australian Department of Home Affairs directly.

4. User Responsibilities

When using VisaMate, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Use the platform only for lawful purposes
  • Verify all generated documents before submission
  • Take full responsibility for your visa application content
  • Not share false or misleading information
  • Not attempt to breach or test platform security
  • Not use the platform to engage in fraudulent activity
  • Comply with all Australian immigration laws and regulations

5. Account and Payment

5.1 Account Creation

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account information.

5.2 Payments and Subscriptions

Some features require payment. By purchasing a service, you agree to:

  • Pay all applicable fees as displayed at the time of purchase
  • Provide accurate payment information
  • Authorize us to charge your payment method

5.3 Refund Policy

Due to the digital nature of our services, all sales are final. Refunds may be issued at our sole discretion in cases of technical issues preventing service delivery or duplicate charges.

6. Intellectual Property

6.1 Our Content

All content on VisaMate, including text, graphics, logos, software, and design, is owned by or licensed to us and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of all content you create using our platform (e.g., Statement of Purpose). By using our service, you grant us a limited license to process and store your content to provide our services.

6.3 Generated Documents

Documents generated by our tools (SOP, forms) belong to you. You may use them for your visa applications. You may not resell or redistribute VisaMate-generated templates.

7. Disclaimers and Limitations

7.1 No Guarantees

VisaMate does not guarantee visa approval, university admission, or any specific outcome. Visa decisions are made solely by the Australian Department of Home Affairs based on their criteria.

7.2 Information Accuracy

While we strive to provide accurate information, we do not guarantee that all information is current, complete, or error-free. Immigration policies change frequently. Always verify information with official sources.

7.3 Service Availability

We provide the platform "as is" and "as available." We do not guarantee uninterrupted or error-free service. We may suspend or terminate services for maintenance or other reasons without notice.

8. Limitation of Liability

To the maximum extent permitted by law, VisaMate and its operators shall not be liable for:

  • Visa application rejections or delays
  • Loss of data or interruption of service
  • Errors or omissions in generated documents
  • Indirect, incidental, consequential, or punitive damages
  • Any damages exceeding the amount paid for our services

9. Indemnification

You agree to indemnify and hold harmless VisaMate and its operators from any claims, damages, losses, or expenses arising from your use of the platform, violation of these terms, or infringement of any third-party rights.

10. Third-Party Links

Our platform may contain links to third-party websites (e.g., university websites, Department of Home Affairs). We are not responsible for the content, accuracy, or practices of these external sites.

11. Termination

We reserve the right to:

  • Suspend or terminate your access for violating these terms
  • Remove or modify content that violates our policies
  • Discontinue any feature or the entire service at any time

You may terminate your account at any time by ceasing to use our services and clearing your local data.

12. Changes to Terms

We may modify these terms at any time. Continued use of VisaMate after changes constitutes acceptance of the modified terms. Material changes will be communicated through email or platform notification.

13. Governing Law and Disputes

These terms are governed by the laws of Australia. Any disputes shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation if negotiation fails
  3. Binding arbitration in accordance with Australian law

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
